This course is designed to give the licensee a comprehensive overview of buyer agency. The history of the shift from mandatory sub-agency to buyer representation that converted the buyer from a customer to a client is discussed in great detail. Once the buyer was given client status, the agent representing the buyer was required to perform his/her duties according to the high fiduciary standards of agency law. These fiduciary duties are discussed along with the duties the buyer's agent owes to third parties. Brokerage company agency policy options are evaluated in the context of buyer agency. The California Agency Disclosure law is also presented to insure the licensee understands the details of agent disclosure compliance. Buyer Representation Agreements are discussed along with the various stages that a buyer's agent must necessarily go through during the representation of a buyer-client. Finally, a brief discussion regarding the marketing of a buyer's agent services is presented.
Course Materials:
This course is composed of approximately 69 pages of text and review quizzes following each course chapter. The course is divided into 5 chapters. A review quiz of 7 questions follows chapters 1 through 5. A quiz score of 70% or greater is required prior to being allowed to proceed to the quiz for the next course section. The 7 quiz questions are selected from a bank of questions and may be in either true/false, multiple choice or fill in the blank format. If the quiz is not passed the first time, 7 more questions are selected from the bank of questions at random. A score of 70% will be required prior to being allowed to proceed to the quiz for the next course chapter. All review exercises are open book. At the end of the course, a final examination is required. The final examination consists of 40 questions and is open book. The questions are selected at random from a bank of final exam questions. The questions may be in either in a true/false, multiple choice or fill in the blank format. The specific mix of questions will be selected by OnlineEd's testing software. A test score of 75% or greater is required for course completion. The final exam must be completed in 60 minutes. All unanswered questions at the end of the 60 minute period will be graded as incorrect. The final examination is not downloadable or printable. The student will be notified of the number of questions answered correctly after the final examination has been completed. The student will not be given the questions which were answered incorrectly.
